1. The basis and scope of the seller's liability to the consumer, if the sold product has a physical or legal defect (warranty), are defined by the provisions of the Civil Code, in particular Articles 556 et seq. 2. Products offered in the online shop may be covered by the manufacturer's warranty. The detailed terms and duration of the warranty are indicated on the warranty card issued by the guarantor and included with the product. 3. The seller is obligated to provide the consumer with a product free from defects. 4. A complaint regarding the purchased product may be submitted by the consumer, in particular in writing to the following address: SPORTANO Sp. z o.o., ul. Nowy Kisielin – Innowacyjna 15, 66-002 Zielona Góra, Poland, or by email to: kontakt@sportano.pl. It is generally advisable to provide the product to the seller with the complaint so that they can examine it. 5. If the product sold has a defect, the consumer may, in accordance with the provisions of the Civil Code: a) Request a price reduction or rescission of the sales contract, unless the seller immediately replaces the defective product with a defect-free product or remedies the defect without undue inconvenience to the consumer. The reduced price must remain proportional to the price agreed upon in the contract, with the value of the defective product being compared to the value of the defect-free product. The consumer may not rescind the contract if the product defect is minor; b) Request the replacement of the defective product with a defect-free product or the remedying of the defect. The seller is obligated to replace the defective product with a defect-free product or remedy the defect within a reasonable time and without undue inconvenience to the consumer. 6. The consumer may request the seller to replace the sold product with a product free from defects or, instead of replacement, to remedy the defect, unless bringing the product into conformity with the contract according to the consumer's choice is impossible or would entail excessive costs compared to the method proposed by the seller. The assessment of whether the costs are excessive takes into account the value of the product free from defects, the nature and extent of the defect found, and the inconvenience to which an alternative remedy would expose the consumer. 7. The seller recommends that the consumer provide the following information in the description of the complaint: (i) details and circumstances concerning the subject of the complaint, in particular the type and date of the defect; (ii) a request for a means of bringing the product into conformity with the sales contract, a price reduction, or termination of the sales contract; and (iii) the contact details of the complainant – this will facilitate and expedite the seller's handling of the complaint. The requirements stated in the preceding sentence are merely recommendations and do not affect the validity of claims filed in deviating from said recommendation. 8. The seller shall respond to the consumer's claim immediately, and at the latest within 14 days of receiving it. If the consumer has requested a replacement of the item or the remedying of the defect, or has submitted a request for a price reduction specifying the amount of the reduction, and the seller has not responded to this request within 14 days, the seller shall be deemed to have accepted the request. 9. If, in order to respond to the consumer's claim or to exercise the consumer's rights under the warranty, it is necessary to provide the product to the seller, the consumer is obligated to provide the product at the seller's expense to the following address: SPORTANO Sp. z o.o., ul. Nowy Kisielin – Innowacyjna 15, 66-002 Zielona Góra, Poland. However, if, due to the type of defect, the type of product, or the way it is assembled, delivery of the product by the consumer would be impossible or excessively difficult, the consumer may be asked to make the product available to the seller, after agreeing on a timeframe, at the product's location, or to provide the seller with photographs of the product. 10. The seller is liable under the warranty if a physical defect is discovered before the expiration of two years from the date of delivery of the product to the consumer. The claim for remedying the defect or replacing the product with a defect-free product is time-barred two years from the discovery of the defect, but in the case of a purchase by the consumer, the limitation period cannot expire before the expiration of the period mentioned in the first sentence.
The refund will be issued using the same payment method as the original order. Once the return has been accepted, the funds will be refunded within a maximum of 4 days from our receipt of the returned package.
